STF Rules Bolsonaro Must Begin Serving 27-Year Sentence in PF Custody

The Supreme Federal Court (STF) ruled on Tuesday (25) that Jair Bolsonaro (PL) will remain in custody at the Federal Police (PF) Superintendency in Brasília, where he has been detained since his pretrial arrest. The STF recognized the conclusion of the coup plot proceedings and consolidated the enforcement of the conviction, set at 27 years and three months. Before being taken to the PF, Bolsonaro was serving pretrial house arrest in a condominium in Jardim Botânico, in the federal capital.

Court Rejects Transfer and Maintains Custody Location

Speculations about a possible transfer to the Papuda Penitentiary Complex were dismissed. Allies had even raised this possibility, but the Supreme chose to preserve the current regime due to legal prerogatives afforded to former Presidents of the Republic.

Cell Structure and Special Conditions

The space where Bolsonaro remains detained underwent a recent renovation. The room measures 12 square meters and follows the State-Major room standard, as provided by legislation to ensure the security and integrity of authorities with functional prerogatives.

The environment includes a private bathroom, bed, desk, wardrobe, air conditioning, television, mini-fridge, and chair. The standard is similar to the room where President Luiz Inácio Lula da Silva (PT) was held at the PF Superintendency in Curitiba, during a period whose conviction was later annulled by the STF itself. Michel Temer was also detained in a PF unit in Rio de Janeiro for four days after his arrest in Operation Descontaminação, an offshoot of Lava Jato.

Prerogatives Provided by Brazilian Legislation

The law stipulates that former presidents are entitled to facilities compatible with their prior role, ensuring differentiated conditions and physical protection. Bolsonaro’s stay at the Federal Police headquarters complies with this provision, avoiding transfer to common penitentiary system units.

Bolsonaro Ineligible Until 2033 After Moraes Decision

Jair Bolsonaro (PL) saw his ineligibility extended until 2033 after STF Justice Alexandre de Moraes ordered the enforcement of his sentence on Tuesday (25). The measure, according to g1 journalist Valdo Cruz’s column, marks the third time the politician has been barred from running for elective office.

According to the report, the new restriction arises from the conviction in the coup plot case, adjudicated by the STF’s First Panel. With the collegial decision, Bolsonaro will remain sidelined from elections for another eight years, added to prior ineligibility rulings by the Superior Electoral Court that initially would have allowed his candidacy in 2030.

Application of the Ficha Limpa Law

In the decision enforcing the sentence against defendants deemed part of the central core of the alleged conspiracy, Moraes applied the Ficha Limpa Law to render all convicts ineligible for eight years from the publication of the collective ruling. The measure directly thwarts the ex-president’s political plans, as he was already barred from the 2026 race.

Despite being unable to run himself, Bolsonaro has sought to maintain his influence in the electoral landscape as a political kingmaker.

Defense Surprised, Prepares Appeals

The sentence enforcement caught Bolsonaro’s defense off guard, though his lawyers had feared this outcome. The legal team had expected Moraes to await the filing of embargos infringentes before ordering compliance. Despite the setback, the defenders have not abandoned applicable appeals and, per the report, plan to file them by next Friday (28).
