STF Rules that Bolsonaro Must Begin Serving Sentence at Federal Police Detention Center

The Supreme Federal Court (STF) ruled on Tuesday (25) that Jair Bolsonaro (PL) will remain in custody at the Federal Police Superintendency (PF) in Brasília, where he has been detained since his preventive arrest. The STF acknowledged the end of the coup d’état trial and consolidated the enforcement of the sentence, set at 27 years and three months. Before being taken to the PF, Bolsonaro was serving preventive house arrest in a condominium in Jardim Botânico, in the federal capital.

The Judiciary rejects transfer and maintains current custody location

Speculations about a possible transfer to the Papuda Penitentiary Complex were dismissed. Allies had raised this possibility, but the Supreme Federal Court opted to preserve the current regime due to the legal prerogatives granted to former presidents of the Republic.

Cell structure and special conditions

The space where Bolsonaro is detained underwent recent renovations. The room measures 12 square meters and follows the standard of a State-Major room, as stipulated by law to ensure the safety and integrity of authorities with special privileges.

The room includes a private bathroom, bed, desk, wardrobe, air conditioning, television, mini-fridge, and chair. The standard is similar to the room where President Luiz Inácio Lula da Silva (PT) was held at the Federal Police headquarters in Curitiba, during a period when his conviction was later annulled by the Supreme Federal Court. Michel Temer was also detained in a Federal Police unit in Rio de Janeiro for four days after his arrest in Operation Decontamination, an offshoot of Lava Jato.

Prerogatives provided in Brazilian legislation

The law establishes that former presidents are entitled to facilities befitting the office previously held, ensuring preferential conditions and physical protection. Bolsonaro’s stay at the Federal Police headquarters complies with this provision, preventing his transfer to common prison system facilities.

Bolsonaro ineligible until 2033 after Moraes decision

Jair Bolsonaro (PL) saw his ineligibility extended until 2033 after Supreme Federal Court (STF) Justice Alexandre de Moraes ordered the enforcement of his sentence on Tuesday (25). The measure, according to g1 journalist Valdo Cruz’s column, marks the third time the politician has been barred from running for elective office.

According to the report, the new restriction arises from the conviction in the coup d’état case, tried by the STF’s First Panel. With the collegial decision, Bolsonaro will remain barred from elections for another eight years, added to prior ineligibility rulings by the Superior Electoral Court that initially would have allowed his candidacy in 2030.

Application of the Clean Slate Law

In the decision ordering sentence enforcement for defendants deemed part of the central core of the alleged conspiracy, Moraes applied the Clean Slate Law, rendering all convicted parties ineligible for eight years from the publication of the collective ruling. The measure directly impacts the ex-president’s political plans; he was already barred from the 2026 election.

Though unable to run personally, Bolsonaro has sought to maintain his influence in the electoral landscape as a political strategist.

Defense caught off guard, prepares appeals

The sentence enforcement surprised Bolsonaro’s defense team, though his lawyers had feared this outcome. The legal team had hoped Moraes would await appeals before ordering enforcement. Despite the reversal, defenders have not abandoned viable appeals and, per the report, plan to file them by Friday (28).
