One Year After 1/8, Brazil’s Supreme Court Keeps 66 People in Prison

One year after the invasion of the government headquarters, Congress, and the Brazilian Supreme Court by vandals dissatisfied with the outcome of the presidential elections, 66 of the more than 2,000 people arrested during the attacks are still in prison accused of inciting, financing, and/or executing the invasion. The numbers, compiled by the office of Minister Alexandre de Moraes, the rapporteur of the investigations, were released by Agência Brasil.

Those investigated have been released and had their imprisonment replaced by precautionary measures, such as wearing electronic ankle bracelets, prohibition from leaving the country, suspension of licenses and certificates for carrying firearms, surrendering passports, and weekly appearances in court.

So far, 25 people have been convicted by the Supreme Court. The sentences range from 10 to 17 years in closed regime.

They are guilty of five crimes: armed criminal association, abolition of the Democratic State of Law, coup d’état, qualified damage, and destruction of protected federal property.

About 1,100 of the investigated will be eligible for an agreement and will not be indicted by the Attorney General’s Office. This measure only applies to those arrested in front of the Army headquarters in Brasília on January 9, one day after the riots, and does not apply to those who participated in the invasion and destruction of public buildings.

Under the agreement, those accused of crimes committed without violence or serious threat can confess in exchange for other measures that do not involve imprisonment – such as repairing the damage caused, surrendering goods obtained from the crime, paying fines, and performing community service.

Pro-democracy events mark one year since 1/8

A series of events will mark, this Monday (January 8), one year since the invasion and vandalism of the Palácio do Planalto, the National Congress, and the Supreme Federal Court. In addition to the official commemoration, various organizations, social movements, and political parties will hold protests in cities across the country. The labor unions, including the Central Única dos Trabalhadores (CUT), have called on their members to participate in activities nationwide to mark one year since the attacks that attempted to destabilize democracy in Brazil.
