Trump Indicted Criminally for the Second Time

On Thursday (9), the Department of Justice presented federal criminal charges against former President Donald J. Trump, accusing him of manipulating confidential documents that remained in his possession after leaving office and then obstructing government efforts to recover them.

Trump confirmed on his social media platform “Truth Social” that he had been indicted. The charges against him include: intentionally retaining national defense secrets in violation of the Espionage Act, making false statements, and conspiring to obstruct justice.

This is the first time a former president faces federal charges. This puts the country in an extraordinary position, given Trump’s status not only as a former commander-in-chief but also as the current favorite for the 2024 Republican presidential nomination.

Trump is expected to surrender to authorities next Tuesday, according to a person close to him and his own post on his Truth Social platform.

“Biden’s corrupt administration informed my lawyers that I was indicted,” Trump wrote in one of several posts around 7 PM on Thursday after he was notified of the charges. In a video released later, Trump stated: “I am an innocent man. I am an innocent person.”

The indictment argues that Trump spent more than a year consistently obstructing the efforts of the National Archives and Records Administration and the Department of Justice to recover hundreds of confidential government records that he took with him when he left the White House.

While the nature of some of the documents found in Trump’s possession is known – he had letters from North Korean dictator Kim Jong-un, for example – it is still unclear what other confidential materials were found at Mar-a-Lago, his property in Florida, and whether there was any damage to national security.

Trump has repeatedly characterized the investigation as a politically motivated witch hunt. However, he was recorded saying that he knew he had confidential documents.

The former president stated in a meeting in July 2021, six months after leaving the White House, that a document in front of him was “classified” and “top secret.” This meeting had already been reported, but new details of Trump’s specific comments seem to explicitly demonstrate that he was aware that the materials he had taken from the White House included confidential information. The recording could become a key piece of evidence in the case against him, as it occurred in July 2021, when National Archives officials had already spent at least two months pressing Trump’s representatives to return the documents they believed he possessed.

  • Improper handling of official documents – Whether the documents relate to national security or not, it is a crime to conceal or destroy official documents.

Other ongoing investigations

The indictment, presented by special prosecutor Jack Smith’s office, comes about two months after New York prosecutors filed more than 30 criminal charges against Trump in a case related to a hush-money payment made to a porn actress before the 2016 election.

Trump is also under investigation by the Department of Justice for his extensive efforts to maintain power after his defeat in the 2020 election and how those efforts led to the January 6, 2021 attack on the Capitol by a pro-Trump mob. He is also being investigated for possible election interference by the district attorney’s office in Fulton County, Georgia.
