Alexandre de Moraes orders arrest of Carla Zambelli

Supreme Federal Court Justice Alexandre de Moraes ordered on Wednesday (4) the arrest of Deputy Carla Zambelli, who announced she had left the country.

Moraes also ordered the blocking of passports (including the diplomatic one) and the deputy’s salary and any other office funds paid by the Chamber. The funds will be allocated to pay the fines imposed by the conviction for invading the electronic system of the National Justice Council (CNJ).

By order of the justice, all assets and accounts of the parliamentarian must also be blocked, including bank accounts, movable and immovable property registered in Zambelli’s name. In addition, the responsible companies have two hours from the moment of notification to block access to the deputy’s profiles on X; Facebook; Instagram; YouTube; Tik Tok; LinkedIn; Telegram and GETTR.

If, even with the block, Zambelli continues publishing texts or videos that reiterate criminal conduct, she will be subject to a fine of R$ 50,000/day, even if posts attributed to her are disseminated on other people’s social media.

Moraes also ordered the Federal Police to take the necessary measures to include Carla Zambelli’s name on Interpol’s list, as well as to report the deputy’s current whereabouts so that her extradition can be requested from the authorities of the respective country.

Moraes’ decision responds to the request from the Attorney General’s Office (PGR) made on Tuesday (3). For Moraes, the arrest order is fully justified, since Zambelli left Brazil weeks after the STF’s First Panel sentenced her to ten years in prison.

“Carla Zambelli announced [on Tuesday] that, after the conviction by this Supreme Court, she fled the jurisdiction of the crime, escaping national territory and that she will ‘return to being the Carla she was before the shackles that this dictatorship imposed on us’”, pointed out Moraes in his ruling.

The justice highlighted that, in the interview she gave to the AuriVerde Brasil channel on YouTube, the deputy herself announced having transferred her social media accounts to her mother’s name – as a way to try to circumvent a possible block of the channels that, according to Moraes, she intended to use to “return to propagating fraudulent news about the electoral process in Brazil”.

Zambelli was convicted by the STF’s First Panel for invading the electronic system of the National Justice Council (CNJ), with the help of hacker Walter Delgatti, who was sentenced to 8 years and 3 months in prison in the same case.

In the same inquiry, the First Panel also sentenced Zambelli to loss of her parliamentary mandate after all possible appeals are exhausted. The forecast is that the declaratory embargoes filed by the deputy and Delgatti will be judged between this Friday (6) and the next day 13. If the sentence is upheld, in addition to being imprisoned, the two will have to pay R$ 2 million in collective moral damages.

The deputy is also responding to another criminal case in the STF, in which she stands as a defendant for having drawn a firearm in broad daylight and, together with security personnel and aides, having pursued journalist Luan Araújo. The episode occurred on the eve of the second round of the 2022 elections and was mentioned by the parliamentarian during this morning’s live.
