Trump Appears and Claims Innocence in Confidential Documents Case

Former President Donald J. Trump pleaded not guilty in a federal court in Miami on Tuesday (13) to 37 criminal charges involving the exposure of defense secrets and obstruction of government efforts to recover confidential documents he took with him when leaving office.

Trump was booked and escorted to a court in downtown Miami. A scene as surreal as it is significant for the history of the country’s politics.

Trump’s aide and co-defendant, Walt Nauta, was also arrested and had his fingerprints taken, but he will not be indicted until June 27.

Here is a summary of what happened at Tuesday’s hearing, which lasted about 45 minutes:

• Judge Jonathan Goodman ruled that Trump cannot communicate with Nauta about the case. The judge also instructed prosecutors to create a list of potential witnesses with whom Trump cannot communicate about the case – except through a lawyer.

• The judge, however, did not impose travel restrictions on either defendant.

• The Department of Justice recommended that both Trump and Nauta be released without financial or special conditions. Prosecutor David Harbach stated that “the government does not see either defendant as a flight risk.”

Before the hearing, officials booked the former president and took electronic copies of his fingerprints. They did not take a photo of Trump because he is easily recognizable. The process took about 10 minutes.

In addition to the federal charges, Trump also faces criminal charges brought by local prosecutors in New York City for an alleged bribery scheme in the 2016 campaign, in which Trump is accused of falsifying business records.

The new charges in the DOJ documents case are drastically more serious and present the possibility of several years in prison if Trump is convicted.

What happens now?

Now the case will enter a routine of pre-trial legal procedures, including likely disputes over which evidence will be presented to a jury to see if the case should be dismissed before going to trial. Trump’s team will have many opportunities to prolong matters – potentially until after the 2024 election.

On his social media, Trump posted before going to court that it was “ONE OF THE SADDEST DAYS IN THE HISTORY OF OUR COUNTRY. WE ARE A NATION IN DECLINE!!!”
