Supreme Federal Court Justice Alexandre de Moraes ordered house arrest for former President Jair Bolsonaro on Monday (4).
Moraes also ordered a search and seizure at the former president’s home in Brasília. The justice also established new measures against Bolsonaro. As such, the former president is prohibited from receiving visits, except from lawyers. Additionally, he is prohibited from using cell phones, including those of third parties.
The measure was ordered after the former president violated the precautionary measure that barred him from using third parties’ social media.
Yesterday (3), during support rallies held across the country, Senator Flávio Bolsonaro (PL-RJ) posted a video on his social media featuring the former president’s statement.
Last month, Moraes ordered several precautionary measures against Bolsonaro, including the use of an electronic ankle monitor and restrictions on social media use, including third-party profiles.
In his decision (access the full document here), the justice highlighted that Flávio Bolsonaro and the former president’s other two sons, Carlos and Eduardo, posted on their social media Bolsonaro’s thanks to supporters who attended yesterday’s rallies. Thus, according to Moraes, there was a violation of the previously ordered restrictions.
“There is no doubt that there was a violation of the precautionary measure imposed on Jair Bolsonaro, as the defendant produced material for publication on the social media of his three sons and all his followers and political supporters, with clear content inciting and instigating attacks on the Supreme Federal Court (STF) and overt support for foreign intervention in the Brazilian Judiciary,” he stated.
The precautionary measures were ordered in the inquiry in which federal Deputy Eduardo Bolsonaro (PL-SP), son of the former president, is being investigated for his actions with the government of U.S. President Donald Trump to promote retaliatory measures against the Brazilian government and Supreme Court justices. In March this year, Eduardo requested leave from his parliamentary term and moved to the United States, alleging political persecution.
In this process, the former president is being investigated for sending funds via Pix to finance his son’s stay abroad. Bolsonaro is also a defendant in the criminal case of the coup plot at the Supreme Court. The trial is expected to take place in September.
