The White House is evaluating ways to provide temporary legal status and work authorizations to immigrants married to U.S. citizens, three sources familiar with the matter reported on Monday (22). The measure could energize some Democrats ahead of the presidential elections in November.
Democratic lawmakers and advocacy groups are urging President Joe Biden to take action to protect undocumented immigrants in the country, as the president simultaneously considers executive actions to reduce illegal crossings at the border.
Immigration has emerged as a major concern for voters ahead of the elections on November 5 this year. The Biden administration has faced criticism from both Republicans and Democrats for its immigration policies.
To make its electorate more satisfied, the White House is examining the possible use of “parole” for spouses of U.S. citizens, the sources said, requesting anonymity.
The temporary status would provide access to work authorizations and potentially a pathway to citizenship. No action is imminent or finalized, the sources said.
A White House spokesperson said the administration “is constantly evaluating possible policy options,” but declined to confirm discussions about these specific actions.
“The administration remains committed to ensuring that those who are eligible for assistance can receive it quickly and to building an immigration system that is fairer and more humane,” the spokesperson said.
It is estimated that 1.1 million undocumented immigrants in the U.S. are married to U.S. citizens, according to data from the advocacy organization FWD.us.
A group of 86 Democrats sent a letter to Biden and Secretary of Homeland Security Alejandro Mayorkas last year, urging them to protect spouses of U.S. citizens and to create a family reunification process for those outside the country.
American citizens married to immigrants without legal status can apply for permanent residency for their spouses without being subject to annual visa quotas. However, immigrants who entered the country without a visa rely on the approval of a waiver to receive a green card. This process can be costly and time-consuming. Granting “parole” and consequently work authorization to this specific group would only expedite the receipt of a right that will come sooner or later.
