Questions have been raised about the legality of the cash incentives offered by tech billionaire Elon Musk to voters in swing states who sign a petition before the presidential election on November 5.
Legal experts argue that it may be a violation of U.S. election laws to offer money for an act that requires the person to be registered to vote.
What exactly is Musk offering?
The petition created by America PAC encourages voters in six swing states – Georgia, Nevada, Arizona, Michigan, Wisconsin, and North Carolina – to sign a “petition in favor of free speech and the right to bear arms.”
Those who indicate another voter willing to sign the document receive a sum of $47.
Larger amounts of over $100 are being offered in Pennsylvania, the state that Trump and Harris’s campaigns believe could decide the elections.
America PAC states that those who sign the petition are signaling their support for the First and Second Amendments of the U.S. Constitution.
Each day leading up to the election day on November 5, a prize of $1 million will be randomly awarded to anyone who signed the petition in one of the seven swing states.
The first check was handed out to a participant at a municipal event in Pennsylvania on October 19.
Is it legal?
“I believe Musk’s offer is likely illegal,” said Paul Schiff Berman, Walter S. Cox law professor at George Washington University, to BBC News.
He pointed to the U.S. Election Code, which states that anyone who “pays or offers to pay or accepts payment for voter registration or for voting” faces a potential fine of $10,000 or a five-year prison sentence.
Musk’s offer is only open to registered voters; however, the strategy may be covered by a loophole because no one is being paid directly to register or vote, but rather to sign a petition.
What do the Democrats say?
Pennsylvania Governor Josh Shapiro, a Democrat, described the action as “deeply concerning” and called for public safety agencies to investigate.
In response, Musk said it was “concerning that he would say such a thing.”
What else is Musk doing?
The world’s richest man has increasingly shown his discontent with Democrats in recent years. He makes no secret of his efforts to elect Donald Trump.
He launched America PAC in July with the aim of supporting Trump’s presidential campaign in 2024. So far, he has donated at least $75 million to the group.
The America PAC website states that it wants “secure borders,” “safe cities,” “free speech,” “sensible spending,” a “fair justice system,” and “self-defense.”
Trump said on Sunday that he did not follow up on Mr. Musk’s donation but described him as a friend.
